Philippine Treaty Traders’ Visa
It is a common view in the Philippines to see foreigners who are engaged in the corporate industry. They go to the Philippines to contribute for the improvement and expansion of the business companies established in the country, whether foreign- or locally-owned.
This is made possible by the Philippine Treaty Traders’ Visa or the 9(D) visa. It permits a foreign national to enter and stay in the country for one year, and realize the purpose stated above.
Eligibility
For a foreigner to obtain a Treaty Trader’s visa, he has to possess the following qualifications:
- Has an intention to help a company in the Philippines with its development and operation
- Has to perform duties that cannot be done with a business non-immigrant visa
- Plans to leave the Philippines at the end of his contract
- Legally hired by a legal local company
US citizens who are applying for the Treaty Trader’s visa should have the additional qualifications:
- The business he will be working for is in accordance with the trade and commerce agreements of the Philippines and the US
- Intends to work for a foreign company or under a foreign national
- Should hold a supervisory or an executive position in the company
Requirements
- Completed general visa application form (BI Form No. MCL-07-01)
- Authentic letter of request from the employer
- Authentic company documents
- SEC Certificate of Registration
- Articles of Incorporation
- By-Laws and General Information Sheet (partnership/corporation)
- DTI Certificate of Registration of Business Name (single proprietorship)
- Latest income tax return and financial statement with BIR stamped-“RECEIVED”
- Copy of passport’s bio and visa page
- Notarized contract of employment
- Clearance certificate from the Bureau of Immigration
Additional Requirements
Applicants for Treaty Traders’ visa may tag along their spouses and, unmarried and minor children, provided that the following additional requirements are complied with:
- NSO-authenticated Marriage Certificate
- NSO-authenticated birth certificates of the children
- Valid passports
