K1 Visa in the Philippines:
Advance Parole


Contrary to what others perceive, an advanced parole has nothing to do with being imprisoned. If your Filipina fiancee has a K1 Visa, applying for an advanced parole is the first thing she needs to do before filing for an adjustment of status.
Briefly defined, advanced parole allows your Filipina fiancee to return to the U.S. in cases where she needs to leave the country. The Department of Homeland Security (DHS) is the agency that issues this permission. Before, this permit can be utilized in emergency cases only, but through the years, the USCIS has become more tolerant in granting this permission due to the application's tedious processing. Leaving the US without an advanced parole means abandoning any application for an adjustment status.

Advance parole requirements

  1. Application for Travel Document or Form I-131
  2. Any document issued by the USCIS showing your current status
  3. An explanation letter that carefully demonstrates valid reasons why your application should be approved
  4. If your Thai fiancee’s departure from the US is due to an emergency, provide relevant evidence
  5. Photocopy and original copy of the receipt notice stating the filing of an application for an  adjustment of status
  6. A copy of a valid ID
  7. Two (2) colored photos
  8. $305 payment fee

Requirements if applying for a person outside the US

  1. A written statement explaining how everyday expenses will be addressed
  2. Form I-134 or Affidavit of Support together with evidence proving the sponsor’s financial capabilities
  3. A written statement explaining why a visa cannot be obtained along with an enumeration of all the steps and processes taken to acquire a visa
  4. A written statement explaining the difficulties of obtaining an inadmissibility waiver along with an enumeration of all the steps and processes taken to acquire a waiver
  5. Copies of any decision made regarding the immigration petition
  6. A statement enumerating and explaining why an advanced parole should be granted

Advanced parole benefits

  1. Your Filipina fiancee can freely leave the US without the need to obtain another visa
  2. Even if your Thai fiancee decides to leave the country, this would affect her application for status adjustment

*Although the advanced parole allows your Filipina fiancee to leave the United States, this does not exempt your partner from experiencing problems on her admission. Thus, the privileges of the advanced parole should be used sparingly.
Note must also be taken that the advanced parole differs from a re-entry permit. Re-entry permits are granted only to those who hold a permanent residence status.
